During this Survey period, courts weighed in on the impact of legislative changes to the Public Employment Relations Act, whether the Michigan Medical Marihuana Act prohibits an employer from discharging an employee for testing positive for marijuana, whether an employer:s directive that an employee seek psychological counseling violates the Americans with Disabilities Act, and the circumstances under which bullying morphs into an actionable sexual harassment claim. Michigan courts were most active, however, in resolving a wide range of issues under the Whistleblowers’ Protection Act, including whether the plaintiff’s motivation in blowing the whistle is relevant to his claim, whether failure to renew a contract is an adverse employment action under the Act, whether a plaintiff can create direct evidence with deposition testimony contradicted by other record evidence, and what evidence is necessary to establish causation. Criminal Law

During the Survey period, the Michigan Supreme Court and Michigan Court of Appeals issued numerous noteworthy decisions in the area of criminal law. This Article examines issues ranging from
homicide to restitution; from the defenses of entrapment and impossibility to possession of a stun gun; and, as in years prior, many decisions interpreting the Michigan Medical Marijuana Act. Read More …

Construction Law

While the topic of construction law implicates several areas of substantive law including contracts, tort, labor and employment, finance, and others, the prevalence of alternative dispute resolution (ADR) provisions in many construction-related contracts necessarily results in the fact that most disputes involving the construction industry are resolved outside of Michigan state and federal courts. Moreover, due to the economic downturn beginning in December 2007, the industry struggled as frozen credit markets postponed or terminated capital projects in Michigan. Notwithstanding these factors, this Survey Article examines developments in Michigan construction law between June 1, 2012 and May 31, 2013—a time of economic hardship and the historic filing of municipal bankruptcy by the City of Detroit.
